PESA Joins Business Effort to Maintain Investment Protection Provisions as NAFTA Renegotiations Commence

NAFTAAs renegotiations of the North American Free Trade Agreement (NAFTA) commence this week, a key issue remaining under consideration is whether to include core investment access and investment protections, enforceable through the investor-state dispute settlement (ISDS) provision. The Trump Administration has expressed concern that ISDS could provide greater rights to NAFTA-country investors than domestic investors. A broad coalition of business and trade associations, led by the National Association of Manufacturers, delivered a strong message of support for maintaining and upgrading ISDS in the modernized NAFTA.
